अप्रैल 2019 नए वित्तीय वर्ष में सुप्रीम कोर्ट द्वारा कर्मचारी भविष्य निधि संगठन की याचिका को ख़ारिज कर दिया है। दरअसल प्राइवेट संस्थान में काम करने वाले कर्मचारियों की पेंशन की गणना अभी तक रूपए 15 हज़ार बेसिक सैलरी के आधार पर की जाती थी। जिससे कर्मचारी पेंशन स्कीम के निवेशकों को सेवानिवृत्ति के पश्चात मासिक पेंशन कम मिलती थी। केरल हाईकोर्ट ने फैसला दिया था कि ईपीएस में निवेश करने वाले कर्मचारियों के पेंशन की गणना उनकी आखिरी सैलरी के आधार पर की जाए। जिसके खिलाफ वर्ष 2014 में कर्मचारी भविष्य निधि संघठन ने सुप्रीमकोर्ट में केरल हाईकोर्ट के खिलाफ याचिका दायर की थी। जिसे 1 अप्रैल 2019 को सुप्रीमकोर्ट द्वारा निरस्त कर दिया गया है। अब निजी सेक्टर के कर्चारियों के पेंशन की गणना इस प्रकार होगी (कर्मचारी की नौकरी के कुल कार्यकाल+ 2 वर्ष)/70xआखिरी सैलरी। जिससे अब ईपीएस के निवेशकों के मासिक पेंशन में वृद्धि हो जायेगी। आइये जाने मासिक पेंशन में कैसे होगी वृद्धि?
EPS Mein Sanshodhan ईपीएस में संशोधन
निजी क्षेत्र के संस्थानों के कर्मचारियों को 1996 तक पेंशन व्यवस्था के अनुसार रूपए 6500 की बेसिक सैलरी के आधार पर मासिक पेंशन प्राप्त होता था। जिसमें वर्ष 1996 में संशोधन के पश्चात बेसिक सैलरी की सीमा को बढ़ाकर रूपए 15 हज़ार कर दिया गया। जिसके आधार पर अब तक कर्मचारी भविष्य निधि स्कीम ((ईपीएस) के निवेशकों को रूपए 15 हज़ार बेसिक सैलरी का 8.33 प्रतिशत निवेश करने पर मासिक पेंशन दिया जाता है। केरल हाईकोर्ट कोर्ट ने फैसला दिया था कि ईपीएस में योगदान करने वाले कर्मचारियों को उनकी आखिरी सैलरी के आधार पर पेंशन की राशि की गणना की जाए। जिसके खिलाफ कर्मचारी भविष्य निधि संघठन ने सुप्रीमकोर्ट में याचिका दर्ज की थी। जिस पर 1 अप्रैल 2019 को सुप्रीमकोर्ट ने अपना फैसला सुनाया और ईपीएफओ की माँग को खारिज कर दिया। अब इस वित्तीय वर्ष से ईपीएस की गणना कर्मचारी के (बेसिक आय + महँगाई भत्ता (DA)+रिटेंशन बोनस) के अनुसार किया जाएगा।

अब सुप्रीमकोर्ट के फैसले के बाद निजी क्षेत्र के कर्मचारियों के पेंशन की गणना ईपीएस के तहत (कर्मचारी के संस्थान में नौकरी के कुल कार्यकाल +2)/70xआखिरी वर्ष की बेसिक सैलरी के आधार पर मासिक पेंशन की गणना की जायेगी। इस आधार पर यदि मान लें कि किसी कर्मचारी की सैलरी 1 लाख रूपए मासिक हैऔर उसने 33 वर्ष तक संस्थान में नौकरी की तो उसे मासिक पेंशन लगभग रूपए 50 हज़ार मिलेगी जो 1 अप्रैल 2019 के सुप्रीमकोर्ट के फैसले से पूर्व रूपए 5,180 होती।
