शत्रु सम्पत्ति बिल भारत में वर्ष1968 से लागू किया गया था। इस अधिनियम के तहत शत्रु देश के नागरिकों की सम्पत्ति के रख-रखाव एवं मालिकाना हक से सम्बन्धित अधिनियम में बदलाव किया गया है। भारत के पड़ोसी राज्य चीन और पाकिस्तान से युद्ध के बाद दुश्मन देश में पलायन हुए नागरिकों की सम्पत्ति को कस्टोडियम के अधिकृत कर लिए जाने का प्रावधान है। वर्ष 2016 में शत्रु संपत्ति अधिनियम में बदलाव किया गया है। बदलाव के तहत नए अधिनियम के अनुसार कस्टोडियम के अधिकार में इजाफा किया गया है। आईऐ जाने शत्रु सम्पत्ति बिल अधिनियम क्या है?
शत्रु सम्पत्ति क्या है Shatru sampatti kya hai
भारत में आजादी के बाद वर्ष 1947 के बँटवारे, 1962 में चीन से युद्ध तथा 1965 एवं 1971 में पाकिस्तान से युद्ध के बाद दुश्मन देश की नागरिकता ले चुके नागरिकों को भारत सरकार दुश्मन मानता है। ऐसे नागरिकों की संपत्ति को सरकार देश की सुरक्षा के मद्देनज़र अपने अधिकार में ले लेती है। इस संपत्ति को अधिकृत करने के लिए भारत सरकार द्वारा 1968 में अधिनियम जारी किये गए थे। अधिनियम के तहत शत्रु संपत्ति में युद्ध के दौरान शत्रु देश में पलायन किये गए नागरिकों के जमीन, मकान, कम्पनियों के शेयर, आभूषण आदि सभी प्रकार की संपत्ति को सरकार द्वारा कस्टोडियम ऑफ़ शत्रु संपत्ति विभाग का गठन किया गया है। इस विभाग को देश की सुरक्षा की दृष्टि से शत्रु संपत्ति को अधिकृत करने का अधिकार प्राप्त है।
शत्रु सम्पत्ति अधिनियम 2017 क्या है Shatru sampatti Act 2017 kya hai
- शत्रु संपत्ति अधिनियम 2017 के तहत चीन एवं पकिस्तान से युद्ध के दौरान भारत से पलायन कर गए नागरिकों की संपत्ति का मालिकाना हक़ कस्टोडियम को प्राप्त होगा। पलायन हुए नागरिकों की सम्पत्ति पर उनके उत्तराधिकारी के स्वामित्व के दावे को भी समाप्त कर दिया जाएगा।
- शत्रु संपत्ति के उत्तराधिकारी के भारतीय होने या शत्रु देश के अतिरिक्त किसी अन्य देश की नागरिकता लेने की दशा में भी शत्रु संपत्ति पर से उत्तराधिकारी के स्वामित्व को समाप्त कर दिया जाएगा।
- कस्टोडियम द्वारा लिए गए शत्रु सम्पत्ति से सम्बंधित किसी भी प्रकार के फैसले को अंतिम माना जाएगा।
- कस्टोडियम द्वारा अधिकृत संपत्ति को उत्तराधिकार को तभी सौंपी जा सकेगी। जबकि अधिकृत संपत्ति शत्रु संपत्ति साबित न हो।
- शत्रु संपत्ति को बेचने का अधिकार भी कस्तोदियम को होगा। जबकि 1968 में बनाए गए अधिनियम के तहत कस्तोदियम को शत्रु संपत्ति बेचने का अधिकार केवल संपत्ति के संरक्षण हेतु रख-रखाव के आधार पर हीं प्राप्त था।
- पुराने नियम के अनुसार यदि अब तक शत्रु संपत्ति को उसके उत्तराधिकार द्वारा विकसित करके उससे आय का साधन बनाया गया है तो अब 2017 के अधिनियम के अनुसार कस्टोडियम उसे अपने अधिकार में ले सकती है। जबकि पुराने निया म के अनुसार शत्रु संपत्ति के उत्तराधिकारी के भारतीय होने पर उससे प्राप्त होने वाले आय का उपयोग कर सकते थे।
